Abstract
In an attempt to overcome disagreements among MS on the reform of the Common European Asylum System, the European Commission has proposed to repeal the Dublin regulation and replace it with the regulation on migration and asylum management. However, this regulation reproduces the already existing system, with minimal changes. Completely new is the flexible solidarity mechanism that should allow MS to participate in the system according to their own discretionary choices.
