Abstract
The article analyzes the main aspects of the judgment no. 192/2023 of the Italian Constitutional Court on the Regeni case. The aim is not only to underline the difficult balancing between rights and constitutional principles but also to point out the particular decision technique used by the Court, which seems more akin to a measure aimed at resolving the concrete case than to a constitutional ruling.
