Abstract
The article consists in a summary and a critical review of the book "Giustizia di transizione e diritto penale" (Transitional Justice and Criminal Law) by Gabriele Fornasari. The book analyses deeply the role attributed to Criminal law in recent political and legal transitions from totalitarian to democratic regimes in Europe, Latin America and Africa, focusing on the risk of violation of fundamental principles and guarantees of Criminal Law, which is inherent in the demand for punishment of those implied in the old regimes.
