Abstract
In three recent decisions the Italian Council of State firmly denied the existence of a right to same- sex marriage. In addressing the questions the judges show a clear opposition to this issue, unknown to the national and supranational judicial decisions on this subject. The article seeks to investigate the reasons for this attitude of the Italian administrative court.
