Abstract
In this text I claim to argue that, in spite of its persuasive power, to set out in terms of a dilemma the choice of a restorative model versus another type is not adequate to make visible and confront the deficits of criminal justice. Restorative justice is a critical and constructive proposal regarding how to understand human interaction and its conflicts. This, however, should not lead us to assume an uncritical attitude towards it, nor to the conclusion that it is necessary to renounce to the enlightened considerations on which criminal law was built
