Abstract
The paper provides a critical analysis of the so called £positive" conscientious objection, recently assumed in the legal debate. It offers a concise preliminary survey of the fundamental dimensions of conscientious objection. Then, it refers to the approach according to which conscientious objection is a fundamental right, founded on the Italian Constitution. This conception stands behind the hypothesis criticized in the paper, which finally provides some remarks on its numerous questionable sides.
