Abstract

This essay analyzes the notions of 'capability' and 'freedom' and their relationship with rights in the normative theory of Amartya Sen and Martha Nussbaum, known as "capabilities approach". The author is critical towards the way in which rights safeguard is coupled with the concepts of positive freedom (in Sen's work), and combined capability (in Nussbaum's).
