Abstract
Costantino Mortati’s theory of material constitution is undoubtedly a fundamental work for Italian public law doctrine. The essay aims to reconstruct its genesis, through the analysis of the doctrinal context in which it was written, to show how Mortati’s work represented a real turning point in the history of theories of the constitution of the European twentieth century
