Abstract
Assuming the central role of the concept of liberty and its function of removing - through the proposal of a formal solution - the ancient problem of justice, the Author questions the logical consistency and the self-sufficiency of the connection among liberty - sovereignty - law which characterises the modern political form. In German classical philosophy - where liberty is a major topic - the relation with the idea and the question of justice re-emerges as a specific problem in Kantian impossibility of reducing liberty to individual wills and in Fichtean questioning the right beyond the law and the state.
