Abstract
The essay reconstructs the concept of regulation in the domain of law. The hyphen in the title Regula-tion defines a rupture that implies a radical break between the understanding of law and politics in the tradition of ius-commune and the economic-privatistic view of the contemporary world. The Begriffsgeschichte serves as a framework for a critique of privatistic regulation. The latter seeks to legitimise itself through historiographical operations, whose anachronisms obscure the radical depoliticisation of law and veil the role of economic coercion as a new mechanism of law enforcement.
