Abstract

The essay analizes Matteucci’s criticism of legal positivism and his attempt to offer «constitutionalism» as an alternative general theory of law. It will also try to show why concepts as «State», «sovereignty» and so on, are of utmost importance for the legal theory and why the concept of «constitutionalism» is essentially ideological.
