Abstract
This paper analyses the philosophical personality of Hans Kelsen. Starting from his early writings on the theory of public law, this work comes to highlight how the concept of constitution has settled in Kelsen the relationship between theory of law and political philosophy. Taken in that sense, in fact, the constitution is not just a procedural rule but also a substantive one.
