Abstract

This article focuses on article 1 of the Constitution of Italy, especially on the notions of people and popular sovereignty. The Constitution of Italy seems to radically innovate the traditional concept of people: traditionally it always had a unitary character, while in the Constitution it is designed as multifaceted and complex. This implies that the holders of the sovereignty are many and that the sovereign decision is only the final result and the compromise of the multiple wills of the social players. This means that the option to exercise the right to resistence at any rate remains open and that the costitutional process never ends. Here lies the radically democratic character of the Italian Constitution.
