Abstract
The contribution critically analyzes the legislative measures adopted in the maritime domain that have defined a legal framework inhospitable to competitive procedures and more prone to favor the stability of the concessionary relationships as to the right to exploit state property. Furthermore, the compatibility problems with the Eu legal regime, that have prompted the European Commission to initiate different infringement procedures, are also illustrated. Finally, the effects stemming from the concession delays are reviewed as to to question whether to continue to make use of legislative solutions similar to those variously adopted (or proposed) over the last fifteen years
