Abstract

The article first reviews a recent European Commission document on the "new learning" in the area of State aids, focusing on the problems of economic analysis of State aids and the difficulty of transferring onto that area the general consensus matured in the field of competition law. The author suggests that perhaps certain incongrousnesses in the area, such as the ones deriving from an indiscriminate recourse to the concept of "selectivity", or the attempt to make the rather vague notion of "market failure" into the lightning rod of future enforcement, may perhaps be more convincingly explained on the basis of a constant federalistic type of effort on the part of the Commission to progressively avocate a good deal of the powers enjoyed by the member States as far as public interventions in the market are concerned. L'articolo muove da un recente documento della Commissione, relativo al "nuovo corso" della disciplina degli aiuti di Stato, concentrandosi in particolare sulle difficoltà nell'analisi economica degli aiuti e sull'impossibilità di trasporre nel settore i risultati conseguiti nell'area dell'antitrust. L'autore si chiede se certe incongruenze nell'applicazione della disciplina, come quelle che derivano dal largo ricorso al concetto di "specificità" dell'aiuto e dal tentativo di fare del nebuloso concetto di "fallimenti del mercato" il parametro fondamentale degli interventi futuri, non siano più facilmente spiegabili quali esempi di un continuo sforzo di tipo federalistico da parte della Commissione, per avocare progressivamente a sé molti poteri di intervento nell'economia, sottraendoli agli Stati nazionali.
