Abstract
The article analyses the recent Microsoft case as decided by the Court of First Instance, by undertaking a sound comparison with the US Microsoft litigations. In this respect, the clash between intellectual property rights and antitrust laws is properly evaluated taking into account the information flow as a pivotal input in fostering competition by innovation.
