Abstract

Law No. 166/2008 finalizes, on the legislative side, the controversial project of preserving the former national air carrier from bankruptcy and safeguarding its Italian identity. In order to get this outcome, the law suspends the antitrust discipline, neutralizing the AGCM's scrutiny of mergers to monopoly for at least three years. Costs, both moral and materials, of this legislative intervention are very high.
