Abstract
The recent decision of the United States Court of Appeals for the Federal Circuit added a new episode to the "Apple v. Samsung saga". The litigation regards the alleged infringement of design and utility patents as well as trade dresses related to the iPhone. The amount of damages awarded plays a significant role in the light of the U.s. peculiar design patent provision. For this reason the Federal Circuit's decision provides a special case for an economic analysis of damages rules in intellectual property law.
