Abstract
The article critically analyses the Facebook tale concerning the violation of user data which led the Ftc to the approval of a first consent order in 2012, and that – following the Cambridge Analytica scandal – prompted the Us agency to reopen the investigation and adopt other remedial measures. The issues surfacing from the story, at the crossroads between privacy and antitrust protection, are framed within the wider debate on these topics, trying to bridge the theoretical scrutiny to the main enforcement concerns. Who is the winner?
