Abstract
The article analyzes the delicate position of the bank in the new institute of the negotiated settlement of the enterprise crisis. In particular, the bank’s position is examined in relation to the various roles it can assume: as a creditor, as a contractual counterparty, as a provider of new finance, as a protagonist or as a subject who undergoes the operations carried out during the negotiated composition or its outcome
