Abstract
Starting from a recent decision of Supreme Italian Court of Cassation on omnibus sureties and competition law, the paper deals with the problem of the validity of guarantees which reproduces ABI scheme and with the problem of the applicable remedial structure, considering the plan of interests protected in banking activity
