Abstract
The essay reconstructs the institution of the National Guarantor for the rights of persons prived of liberty as a point of connection between national and international instances of protection of the rights of persons at risk of restriction of their liberty. In this framework, it describes the inclusion of the area of disability among the fields of competence of the National Guarantor for the rights of persons deprived of their liberty. The field of disability is configured as a “privileged operational spaceµ which allows to monitor the risks of institutionalisation and to develop tools for the effective protection of the rights enshrined in the UN Convention on the Rights of Persons with Disabilities.
