Abstract
The article analyses, from the perspective of law and literature, the work of Emmanuel Carrère and in particular, an early work dedicated to uchrony in the literary and political fields; then, it proposes an analysis of the problem of the retroactivity of the judicial decision, identifying, also in the legal sphere, the typical elements of the uchronic narrative in the court ruling
