Abstract

The essay outlines the fundamental characteristics of critical theories of law, and focuses on critical studies on migration. It pays attention to their usefulness in outlining both the strategies and the legal mechanisms that produce the discrimination between migrant and citizen, and the capability of the migrant, by crossing the borders, to question the foundation of the State and to bring the tension between rights of the citizen and universalism of rights.
