Abstract
This paper aims to discuss the predominant role of “private powersµ in the institutional framework of sport, both at the national and international levels. It charts the different relationships between such a framework and States. By focusing on the Italian constitutional arrangement, the article reveals how and to what extent sports organisations affect the fundamental rights of sportspersons and athletes. It concludes that the relationships between the said organisations and government greatly influence public institutions’ capacity to protect citizens’ rights vis-à-vis sports corporatism
