Abstract
The focus of the essay is oriented on the legal meaning and the question of national position statements about the Rule of Law as a common value, after the EUCJ decisions on the Conditionality 2020 EU Regulation. The mutual trust among member States, as a tool of an ever-closer union and the «macroeconomic dimension» of the EU Rule of Law are also analysed. Dealing with the question of how the Rule of Law has to be intended and implemented in order to cope with democracy, the work comes to the conclusion that the EU Rule of Law cannot be intended as an instrument of political dominance by the EU institutions and legal system on national constitutional systems
