Abstract
This Paper proposes a reflection on the initiatives taken by the EU Institutions for the realization of a common asylum procedure and a uniform status. The objective of simplifying and systematizing the CEAS, developed over the years and today compromised because of the tensions concerning the European integration process, risks leading to a tendential «lowering» of the standards adopted by the EU in the protection of the fundamental rights of applicants. In this a context, characterized by heterogeneity and fragmentation, a fundamental role is played by the jurisprudence, which traditionally acts as an element of convergence between systems and balance between tensions and conflicting interests.
