Abstract

This essay summarizes how the Court of Justice of the European Union is effectively confronting the latest polish legal reforms that threaten judicial independence. The paper aims to highlight how such jurisprudence brought to the emergence of a European principle of judicial independence, based on both Article 19 of the Treaty on European Union and Article 47 of the Charter of Fundamental Rights of the European Union.
