Abstract

This contribution takes the Constitutional Court decision no. 115/2011 as a starting point for studying recent trends on powers of order. Art. 54 of legislative decree on local authorities, about orders of the mayor, regulates government practice in the field of civil protection orders, which are becoming instruments of ordinary administration rather than emergency instruments. These trends are objected by Constitutional Court, since they originated undue strengthening of the chief of the executive and, therefore, an alteration of the form of government provided by the Constitution.
