Abstract

After a review of the historical development in Italy of the public interest in cultural goods, wherein the public ownership has always been considered an essential instrument, the article considers le case of Museums, as the place in which the public ownership reveals its cultural and civilising functions. The new Code does not allows the sale of collections, but it allows the sale of the buildings: more than the immediate risk, it is the principle of separating cultural good from their contest which is wrong.
