Abstract
The legal framework of welfare benefits has gone through social and regulatory changes and nowadays outlines the conditions of effectiveness and guarantees that make them «law in action», and no longer the random outcome of local services supply. Despite the limits of the Italian civil judge towards the administration ruling both the judicial enforcement and the discretion of operators who perform needs assessment proceedings contribute to the functioning of an expensive management system.
