Abstract

The last twenty-five years are marked by concerns: the processes of democratization in the world appear to be in regression: threats to the rule of law are even registered within the European space. The specific questions that arise for Italian scholars are linked to the return of the war of aggression; the difficulties in creating long-lasting homogeneous Governments; in terms of the transition of the type of State, concerns about poorly coherent devolution processes; on the role of the guarantee bodies, in addition to reiterating their importance in a context of challenge by self-styled “illiberal democraciesµ, enhancing their function as "moderators of the Constitution".
