Abstract
The post-law hypothesis is closely linked to the presupposed concept of law. In the light of an institutional theory of law, the paper suggests that the problem of the end of law is a modern problem, inconceivable for the ancient and medieval legal culture, based on the maxim ubi societas ibi ius. In the current “liquid modernityµ, where the symbolic function of the “thirdµ is in deep crisis, it is possible to imagine a dystopian future in which, since there is no longer any society, even law would no longer be there
