Abstract
This note analyzes the ideas exposed by Andrei Marmor, professor at the University of Southern California, in his recent book Philosophy of Law. In this volume, Marmor proposes a re-formulation of the positivistic model - in the "exclusive" trend - and tries to supersede some of the main critiques made to the model. His proposal is the subject of many critiques in this note, mainly about its methodological reductionism and the intent of justifying the authority and obligatory nature of the law only on social facts.
