Abstract
The paper focuses on the relation between torture and law. It deals with its historical development and the related conceptual tensions. Proceeding from the recent debate on the legitimacy of torture in the context of the so-called war on terror, the paper considers relevant arguments in favour of the relegalizing solution. It finally attempts a critical strategy that points out what in the end is the core of the problem: the concept of law.
