Abstract
The contribution (which is a review of Tommaso dalla Massara’s volume) dwells on some aspects of Siegmund Schlossmann’s critique against contract and against the will and freedom of contract. In particular, following the line of the constant intertwining of actuality and inactuality, some aspects of Schlossmann’s actuality are highlighted, especially relating to the idea of a law and legal system in constant transformation
