Abstract

The aim of this paper is to analyse the evolution of the debate related on the legal nature of smart contract and its referability to the traditional category of the contract. For this reason, the investigation will be focused on some of the most relevant legal issues that emerge in connection with smart legal contracts. In this regard, the analysis will attempt to explain what a smart contract is and whether the Law of Contract is applicable to this technology. Lastly, the possible extension to smart contracts of the discipline dictated on contractual remedies will be stressed.
