Consumer Protection in Distance Marketing of Crypto-Activities

Abstract

The article addresses the coordination of the corpus of existing (and forthcoming) EU instruments of consumer protection (particularly, in the field of distance marketing) with the proposal of a Regulation on Markets in Crypto-Assets (MiCAR). After dealing with the general interaction between rules of market regulation (on financial instruments, on securities, etc.) and rules pertaining to the horizontal relations between professionals and consumers, the article delves into two main issues regarding initial offers, custody and administration, and transfers of crypto-activities: 1. The professional’s duties of disclosing and providing key information to the contracting consumer; 2. The consumer’s right of withdrawal from the contract she or he has entered into.
