Abstract

Title III of the Proposal for a Directive on collective management of copyright and related rights and multiterritorial licensing of rights in musical works for online uses, represent an absolute novelty, from a regulatory perspective, in European copyright law. This paper, after some preliminary observations about the background and the needs of cross-border digital exploitation of musical works, examines competitive issues that arise from the drafting of the Proposal and points out some specific concerns related to the EU competition policy approach in this field.
