Abstract

The contractual types used in the market of natural gas do not generally raise qualification issues. In most cases, they are well known to civil lawyers and include the sale and purchase agreement, the supply agreement, and the service contract. Nonetheless, these agreements are drawn under a common framework, calling for their reciprocal interplay and intermingling, by virtue of the fact that they refer and be long to a unified distributorship infrastructure. This system has seen an increase due to: (i) the reform of the terms and conditions applied to final clients of the so-called customer care (servizio di tutela); (ii) the interim and reparatory measures in the event of «agreements not asked for»; (iii) the case in which the final client remains without a distributor, by reason of unpaid balances or for other causes not related to its will.
