Abstract
The article concerns the matter of the gaps resulting from the voidness of the unfair terms. In particular, the paper, in the light of the judgments of the European Court of Justice, addresses the following questions: the meaning of the principle of contractual transparency and its influence on the assessment of the standard terms in consumer contracts; the supplementation of the contract by default rules to replace the unfair terms in the context of the effective protection of the consumer; the controversial issue of the judicial supplementation of the contract and its limits; the obligation of the national courts to examine of its own motion the unfairness of the standard terms; the coordination between domestic and European measures of consumers protection in contract law.
