Abstract

A new complexity between efficiency and consistency with the legal system. The essay examines some recent Italian regulations issued to contrast negative effects of the economic crisis in the European legal context. It focuses in particular on the new rules about the market liberalization, the bank insolvency, the so-called «civil insolvency» and the credit guarantees. It aims to analyze the impact of these reforms on the Private law system and to identify a possible new regulation strategy, based on the supervisory powers of independent Authorities.
