Abstract

The article deals with the long lasting evolution of EU and italian regulation about banking contracts transparency. Its prupose is discussing the main characters of the actual regulation, particularly the great complexity, trying to identify some keys to give more consistency to the legal system. In the first part, the paper analyzes the different choices of the legislator in the various sectors of Italian and UE law (consumer credit directive, payment services directive, mortgage credit directive). In the second part, we focus on the different criteria to organize the regulation (transparency or customer protection?; competitive or anti-competitive rules?; customer or consumer protection?; permanent and fixed-term contracts; etc.).
