Abstract

In examining the institution of the termination for breach of contract, constantly fluctuating between the «judicial» and the «out-of-court» model, this volume collects several papers by the doctrine of civil law and civil procedure who, starting from the examination of the new regulations introduced into the French legal system of remedies for the termination of contract and of some jurisprudential decisions as well, offer the reader a systematic reflection on this instrument of cancellation of the contract. As a result the emphasised disintegration of the normative scheme of the termination for breach of contract and the enhancement of the private autonomy seem to emerge.
