Abstract

The book under review in this note is written by a former justice of the Italian Constitutional Court and contains nine comments on as many decisions of the Court. The book has sparked some controversy, considering that Italian legal tradition does not allow for the publication of dissenting opinions. In fact, the Author doubts whether there is an explicit prohibition to this effect; and, at any rate, he carefully avoids mentioning other justices’ opinions. The book factually calls for a renewed discussion on dissenting opinions in the Constitutional Court. It is to be hoped that also political scientists will participate in the debate, as neither the object of the discussion nor the arguments usually deployed in it are of a solely legal nature.
