Abstract
The article reconstructs the controversy between Hold-Ferneck and Kelsen related to the notions of state, law and compliance with the rules. Hold-Ferneck’s analysis presents harsh critical observations. His position on the point shows clearly that he is aware about both the theoretical, and mostly, the political issue at stakes.
