Abstract

This paper is a first approach to the traditional problem of causation in the field of criminal product liability, focusing on the contributions that can be provided by the development of big data analysis nowadays. Based on well-known cases in this field, it constitutes a reflection on the contribution of big data analysis and correlations to determine the causal link, which is particularly problematic when the existence of an empirical, deterministic causal theory is not assumed, and the use of probabilistic evidence is considered.
