Cultural goods in the third Public Contracts Code: continuity, discontinuity, delegification
Abstract
The paper examines the provisions of the new public procurement code on contracts relating to cultural heritage. First of all, the research focuses on the profiles of continuity and discontinuity in the legal discipline of the public contracts in this field, comparing both the previous and the actual code. Then, the analysis moves on the field of application, especially about the prohibition of availment, and on the qualification of the executors. In the end, the paper deals with the planning, the variations and the testing, and finally on the special forms of public-private partnership.
