What protection for the right to the image of cultural heritage? (reflections on the cases of Leonardo da Vinci’s Vitruvian Man and Michelangelo’s David)
Abstract
The paper, taking as its starting point two rulings by the ordinary courts, reflects on the regulatory framework on the use of the image of cultural property. The analysis highlights some of the critical elements that the system presents and underlines how the protection of the right to image stands at the crossroads between the functional intangible and the economic intangible of cultural property.
