Abstract

The essay addresses the issue of landscape protection of a cultural tourism route through the measure of declaration of public interest. After recalling the prevailing positions of administrative jurisprudence on the exercise of the ministerial power of constraint, it reconstructs the essential features of the regulation of cultural tourist itineraries, in the light of a recent draft law on the subject, and concludes with some reflections on the issue of the relationship between cultural tourist itineraries and the development of fragile territories and on the appropriateness of the use of the power of constraint (and its limits) in similar cases.
